The Supreme Court has finally announced its decision on the registration of BS4 vehicles, stating that any BS4 vehicle sold after March 31 will not be registered anymore. That leaves about 39,000 vehicles not eligible for registration under the apex court’s decision.
Until now, there had been some uncertainty regarding the registration of BS4 vehicles that were sold around March, 2020. The Supreme Court has finally announced their decision regarding the registration of BS4 vehicles, stating that only those BS4 vehicles will be allowed to register that were sold prior to the lockdown and details of which were uploaded on the eVahan portal. This leaves about 39,000 vehicles that will not be eligible for registration under the apex court’s ruling.
Thus, BS4 vehicles who’s details have not been uploaded on the eVahan Portal and those that were sold after March 31 will not be registered any more. This ruling however does not apply to vehicles in the Delhi-NCR region as the Delhi Government had already ruled out the registration of any more BS4 vehicles earlier. According to data submitted by the Ministry of Road Transport and Highways (MoRTH), over 11 lakh BS4 vehicles were sold between March 12 and March 31 this year.
Interestingly, of these 11 lakh vehicles, 2.5 lakh BS4 vehicles were sold between March 29 and March 31 alone and that’s despite the nationwide lockdown that was in place then. The Federation of Automobile Dealers Association (FADA) also released some data which claims that a combined sale of over 2.25 lakh BS4 vehicles that comprises 94,076 vehicles sold by members, and 131,717 vehicles sold by non-members. Out of the BS4 vehicles sold prior to March 31, 2020, 39,000 vehicles could not be verified by the eVahan Portal.

The Supreme Court had previously passed an order barring the registration of BS4 vehicles until a concrete decision was reached on this front. On July 31, the Supreme Court even expressed its displeasure on the sale of a huge number of BS4 vehicles in March during the lockdown, stating that the numbers were unusually high. Justice Mishra also asked Senior Advocate, KV Vishwanathan, “Is this not a fraud on the Court that you say that there will not be many sales during this period and then the sale is higher during this lockdown period?”

However, Advocate KV Vishwanath appealed on behalf of the FADA that several methods like discounts and slump sales were used by the dealerships to clear the stocks as the manufacturers were not ready to take back the stock/inventory. He pleaded the court to allow the registration of such vehicles. This entire confusion arose in the first place because while the automobile industry was transitioning from BS4 to BS6 from April 1, 2020, the country was under a lockdown. Thus, BS4 vehicles brought prior to April 1, 2020 could not be registered as RTOs were closed and manufacturers too were left with huge unsold BS4 stock which they desperately tried to clear at the last moment.
